What is an escritura pública and why is it important?

An escritura pública is the official public deed that records the transfer of property ownership in Spain.

It is prepared and witnessed by a notary (notario) and constitutes the legal proof of your property purchase.

The document contains full details of the property including its description, boundaries, registry reference number, the agreed price, payment method, and any conditions attached to the sale.

Once signed, the escritura is presented to the Land Registry (Registro de la Propiedad) for inscription, which gives you full legal protection as the registered owner.

There are two types: the primera copia (first copy) which is the original notarized document with full legal standing, and the copia simple (simple copy) which is an informational copy without legal force.

You should always keep your primera copia in a safe place.

The escritura costs are based on the property price and are part of your closing costs.
